1. Agreement to Terms

By accessing or using the RankTopAI website and platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

RankTopAI is operated by RankTopAI Inc., New York, NY, United States ("Company", "we", "us", or "our").

2. Description of Service

RankTopAI provides an AI search optimization platform that enables users to track, analyze, and improve their brand's visibility in AI-powered search engines including ChatGPT, Claude, Google Gemini, and Perplexity. Features include GEO audits, competitor analysis, keyword exploration, and optimization recommendations.

3. Accounts and Registration

• You must be at least 16 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information during registration.
• Notify us immediately at [email protected] if you suspect unauthorized use of your account.

4. Subscriptions and Payment

Paid plans are billed on a monthly or annual basis, as selected at checkout. Payments are processed securely by Stripe. By providing payment information, you authorize us to charge the applicable fees on a recurring basis.

• Free plan — Available with limited feature access; no credit card required.
• Growth plan ($49/mo) — Includes expanded usage limits and full feature access.
• Scale plan ($199/mo) — Includes highest usage limits, priority support, and enterprise features.

All prices are in USD and exclude applicable taxes. We reserve the right to change pricing with 30 days' notice to existing subscribers.

5. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.

We offer a 7-day money-back guarantee for first-time paid subscribers. To request a refund, contact [email protected] within 7 days of your first charge. Refunds are not available for subsequent billing periods.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Transmit malware, spam, or other harmful content
• Attempt to reverse engineer, scrape, or create derivative products from the Service
• Use automated tools to generate excessive API calls beyond your plan limits
• Misrepresent your identity or affiliation
• Engage in any activity that disrupts or burdens the Service infrastructure

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of RankTopAI Inc. Our trademarks may not be used in connection with any product or service without our prior written consent.

Reports, analyses, and other outputs generated by the Service are licensed to you for your internal business use. You may not resell or redistribute Service outputs without written permission.

8. Third-Party Services

The Service integrates with third-party APIs and services (e.g., DataForSEO, OpenAI, Typesense). We are not responsible for the availability, accuracy, or content of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that any specific results will be achieved. AI search visibility depends on many factors outside our control, including the policies and algorithms of third-party AI platforms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANKTOPAI INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless RankTopAI Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, NY.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or a prominent notice on our website. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
